Annual leave regulations are detailed in s 54 of the Employment Act 2006, which states that annual leave entitlements apply to employees who have at least a six months continuous employment record with their employer or, if working under a contract of service, they work for 16 hours a week or more.

The act allows for an entitlement equivalent to seven days leave earned for every four months worked. There is also provision for 21 days holiday per year being allocated and taken at any time agreed between employer and employee, allowing for a more flexible approach.

The act also stipulates that a payment must be made in lieu of holiday pay for unused holidays accrued at the time of termination of an employee's contract.

Employees can expect to receive full pay when taking annual leave. Pay for annual leave days must be the same as if the employee was still working
