Stop press: The procurement Bill received Royal Assent on 26 October 2023, becoming the Procurement Act 2023. This Practice Note is being reviewed in light of this legislation. See: LNB News 26/10/23 81.

framework agreements are used in the procurement of construction projects in both the public and private sectors. They are, however, more extensively found in the public sector where they are subject to the public procurement rules. This Practice Note examines the procurement and tendering of frameworks in both sectors. It considers the regulation of framework agreements in the public sector and also looks at the duration of framework agreements and pricing under them and at how the terms for the individual contracts for works/services are dealt with in the framework (‘call-off’). This Practice Note also contains links to other content that examines issues relating to frameworks in the public sector in more detail

For more about what frameworks are and why parties might enter into a framework agreement, see Practice Note: Introduction to framework agreements for construction lawyers.
