What does Right to Rent mean?

Every landlord must check that tenants can legally rent residential property. Landlords must check a tenant’s original acceptable documents (eg passport) allowing them to live in the UK, must keep the copy documents on file and record the date of the check. Copies of the documents must be kept for the time of the tenancy and one year after.

If land is unregistered, L (a freeholder) grants T (tenant) a lease of that land and T is then dispossessed by S (squatter), the 12-year limitation period runs: • against T, from the date of dispossession, and • against L, from the date of expiry of the lease If the 12-year period is established before the expiry of the lease, S can then retain the land, as against T, during the rest of the term. MHCLG announces HSRAs to revitalise town centres

The Ministry of Housing, Communities and Local Government (MHCLG) has announced the implementation of High Street Rental Auctions (HSRAs), effective from 2 December 2024. This new legal power, introduced by the Levelling Up and Regeneration Act 2023, empowers local councils and authorities to auction leases for commercial properties that have been left vacant for over 365 days within a 24-month period. The government has committed £1m to support the auction process, which aims to revitalise high streets by offering businesses and community groups a 'right to rent' vacant town-centre commercial properties. The HSRAs are part of the government’s broader strategy to support local businesses, with a new Small Business Strategy expected to be published in 2025, outlining further support for small and medium-sized enterprises, including improved access to finance and domestic and overseas markets.
