Costs in Criminal Cases (General) Regulations 1986 (SI 1986/1335)

(1)     Regulation 14 of the Costs in Criminal Cases (General) Regulations 1986 is amended as follows.

(2)     In paragraph (1)(a), for “section 42 of the Powers of Criminal Courts Act 1973†substitute “section 21 of the Sentencing Code as it applies by virtue of subsection (1)(a) or (c) of that sectionâ€.

(3)     Omit paragraph (3)(a)(i) to (iv), (vi) and (vii).

(4)     Omit paragraph (3)(b)(i) and (ii).

(5)     After sub-paragraph (b) of paragraph (3) insert—

“(c)     under any of the following provisions of the Sentencing Code—

(i)     Schedule 2 (commission of further offence by person conditionally discharged);

(ii)     paragraph 7 of Schedule 4 (power of court on referral back from panel);

(iii)     Part 1 of Schedule 5 (breach of reparation order);

(iv)     Part 2 of Schedule 10 (breach of requirement of community order);

(v)     Part 2 of Schedule 16 (breach of community requirement of suspended sentence order or conviction of further offence).â€
