SCHEDULE 6 Changes to, and Revocation of, Orders Granting Development Consent

Section 153

Preliminary

(1)     This paragraph applies for the purposes of this Schedule.

(2)     “The applicantâ€, in relation to a development consent order, means the person who applied for the order.

(3)     “A successor in title of the applicant†means a person who—

(a)     derives title to the land from the applicant (whether directly or indirectly), and

(b)     has an interest in the land.

(4)     . . .

(5)     “Development consent order†means an order granting development consent.

(6)     “The landâ€, in relation to a development consent order, means the land to which the order relates or any part of that land.

Non-material changes

(1)     The [Secretary of State] may make a change to a development consent order if [the Secretary of State] is satisfied that the change is not material.

This is subject to sub-paragraph (13).

[(1A)     The Secretary of State may by regulations make provision about—

(a)     the decision-making process in relation to the exercise of the power conferred by sub-paragraph (1);

(b)     the making of the decision as to whether to exercise that power;

(c)     the effect of a decision
