35 听笔谤辞肠别诲耻谤别

(1)听听听听 If the Secretary of State decides that a person (鈥淧鈥) is liable to one or more penalties under section [31A or] 32, he must notify P of his decision.

(2)听听听听 A notice under subsection (1) (a 鈥減enalty notice鈥) must鈥

(a)听听听听 state the Secretary of State's reasons for deciding that P is liable to the penalty (or penalties);

(b)听听听听 state the amount of the penalty (or penalties) to which P is liable;

(c)听听听听 specify the date before which, and the manner in which, the penalty (or penalties) must be paid; and

(d)听听听听 include an explanation of the steps鈥

(i)听听听听 that P must [may] take if he objects to the penalty;

(ii)听听听听 that the Secretary of State may take under this Part to recover any unpaid penalty[; and

(e)听听听听 be issued before the end of such period as may be prescribed].

(3)听听听听 Subsection (4) applies if more than one person is responsible for a clandestine entrant.
