[78L  Appeals against remediation notices]

[(1)ÌýÌýÌýÌý A person on whom a remediation notice is served may, within the period of twenty-one days beginning with the day on which the notice is served, appeal against the notice–

(a)ÌýÌýÌýÌý if it was served by a local authority, to a magistrates' court or, in Scotland, to the sheriff by way of summary application; or

(b)ÌýÌýÌýÌý if it was served by the appropriate Agency, to the Secretary of State;

[(a)ÌýÌýÌýÌý if it was served by a local authority in England [or by the Environment Agency], to the Secretary of State;

(b)ÌýÌýÌýÌý if it was served by a local authority in Wales [or by the Natural Resources Body for Wales], to the National Assembly for Wales;]
