SCHEDULE 11 Local Air Quality Management Framework

Section 72

The Environment Act 1995 is amended as follows.

(1)     Section 80 (national air quality strategy) is amended as follows.

(2)     Omit subsection (3).

(3)     After subsection (4) insert—

“(4A)     The strategy must be reviewed, and if appropriate modified—

(a)     within the period of 12 months beginning with the day on which this subsection comes into force, and

(b)     within each period of 5 years beginning with the day on which the person carrying out the review completed their most recent review under this subsection.â€

After that section insert—

“80A Duty to report on air quality in England

As soon as reasonably practicable after the end of each financial year, beginning with the financial year in which this section comes into force, the Secretary of State must lay a statement before Parliament that sets out—

(a)     the Secretary of State's assessment of the progress made in meeting air quality objectives, and air quality standards, in relation to England, and

(b)     the steps the Secretary of State has taken in that year in support of the meeting of those objectives and standards.â€

After section 81 insert—
