What does Undertaking (business) mean?
Every entity engaged in an economic activity regardless of the legal status and the way in which it is financed. See Court of Justice ruling in Case C-41/90 Hofner and Elser v. Macrotron GmbH [1991] ECR I-1979.
EU and UK competition laws apply to undertakings and while the term is not defined in the Treaty on the Functioning of the European Union or the Competition Act 1998, its meaning is well understood from Court of Justice case law.
