National implementing measure definition

What does National implementing measure mean?

A national legal act adopted by the Member States to implement, transpose or give effect to the requirements of a specific EU legal act, usually a Directive.

The term associated with the legislation issued by a Member State to implement a Directive – although the EU piece could also be a Decision. Even though those measures are usually of a legislative nature Member States can choose to implement EU legislation via administrative measures but those must be binding, since that is required by the EU legal system. Commonly known as implementing legislation, the term should be understood as also encompassing administrative measures as otherwise it would restrict its scope under EU law. The measures need to clearly state that they implement/transpose a specific EU legal act and must be notified to the EU Commission, which will assess their level of compliance with the EU piece. Please note the Court of Justice is reluctant to recognise administrative measures as implementing measures but the EU Commission accepts them – though always in combination with other implementing measures of legal
