What does DCO mean?

consent-order-'>development consent order: Developers of nuclear power stations must apply to the Planning Inspectorate (rather than the Local Planning authority) for a Development Consent Order. If granted, a DCO will combine a grant of planning permission with a range of other separate consents, such as listed building consent. A DCO can include rights to compulsorily purchase land. There are also special procedures relating to cases such as commons, National Trust land, and land protected under the Green Belt (London & Home Counties) Act 1938.

Promoting a compulsory purchase order, including preparing the order and order documents and making the order Context There are a large number of statutory provisions which grant compulsory purchase powers for specific purposes to specified bodies, see Practice Note: Sources and limits of compulsory purchase powers. Authorisation of compulsory purchase is commonly conferred by a compulsory purchase order (CPO), which is made by the specified body (the acquiring authority) and then confirmed by the confirming authority (which is the minister having the power to authorise the acquiring authority to purchase the land compulsorily, or an inspector appointed by that minister to act instead or in some cases the acquiring authority). This Practice Note focuses on the procedure for promoting a CPO to which the Acquisition of Land Act 1981 (ALA 1981) applies. ALA 1981 applies to most compulsory acquisitions by public bodies, although separate procedures may apply, for example, where compulsory acquisition is proposed as part of development consent orders under the Planning Act 2008 (PA 2008)...

Multi-party and multi-contract arbitration—an introduction This Practice Note considers how some of the common challenges which can arise in disputes between multiple parties (multi-party disputes) and/or concerning multiple contracts (multi-contract disputes) may be managed in arbitration proceedings. Such proceedings are sometimes referred to as ‘complex arbitrations’, although that phrase bears other meanings too. Multi-party and multi-contract disputes are common, reflecting the complexity of international commercial transactions. As discussed in Practice Notes: Arbitration—an introduction to the key features of arbitration and Arbitration—new starter guide, arbitration is, typically, a private, contractual method of dispute resolution, which offers parties meaningful control over who determines their dispute and the procedure that will be followed. How is a breach of a development consent order enforced? Development consent orders (DCOs) are a form of development consent granted by the Secretary of State which authorise the development of Nationally Significant Infrastructure Projects (NSIPs). The Planning Act 2008 (PA 2008) introduced a faster and more transparent development consent system for NSIPs. Projects falling into one of the categories of NSIPs in PA 2008, Pt 3 must proceed via this streamlined system (see Practice Note: Permission for nationally significant infrastructure projects for a list of projects which constitute NSIPs). Enforcement of PA 2008 regime is carried out by the relevant local planning authority (LPA), which pursuant to PA 2008, s 173 is the authority for the area within which the project is situated. In areas where there are both a district and county authority the district authority will assume responsibility for the enforcement of DCOs (except projects involving hazardous waste facilities, where the county authority will handle enforcement). Under the Town and Country Planning Act 1990 there is a mechanism in place for dealing with applications to discharge planning conditions. Is there a similar regime in relation to requirements imposed on a Development Consent Order under section 120 of the Planning Act 2008? Discharging planning conditions under the Town and Country Planning Act 1990 Town and Country Planning Act 1990, s 73 (TCPA 1990) allows for the determination of applications to develop land without compliance with conditions previously attached. TCPA 1990, s 73A allows applications to be made in relation to planning permission for development already carried out without complying with a planning condition on the permission. Developers can modify a planning condition by applying to the local planning authority (LPA). The LPA must only consider the disputed conditions that are the subject of the application—it is not a complete re-consideration of the application. Planning analysis: In Save Stonehenge World Heritage Site v Secretary of State for Transport, the court had to consider whether the process of redetermining a development consent order (DCO) previously quashed by the court had been conducted fairly and properly. It confirmed that public decision making involved in the DCO procedure is not a form of litigation. As such, the statutory process and common law principles of procedural fairness do not dictate that issues must always be considered by an inquisitorial process. Where there is not a statutory requirement for an inquisitorial process (such as on redetermined DCOs), claimants need to demonstrate that there was a particular need for evidence to be interrogated such as between independent experts on the issues under further consideration. Moreover, for claimants to prove procedural unfairness they must show that they have suffered material prejudice. Neither were established in this case.
